Disability Insurance

Who can apply: Anyone who is unable to work due to medical quarantine or illness related to COVID-19 (certified by a medical professional).

Description: Short-term benefit payments to eligible workers who have a full or partial loss of wages due to a non-work-related illness, injury, or pregnancy.

Benefit: Approximately 60-70 percent of wages (depending on income); range from $50-$1,300 a week for up to 52 weeks.

Eligibility:

  • Be unable to do your regular or customary work for at least eight days.
  • Be employed or actively looking for work at the time your disability begins.
  • Have lost wages because of your disability.
  • Have earned at least $300 from which State Disability Insurance (SDI) deductions were withheld during your base period.
  • Be under the care and treatment of a licensed physician/practitioner or accredited religious practitioner within the first eight days of your disability. The date your claim begins can be adjusted if it does not meet this requirement. You must remain under care and treatment to continue receiving benefits.
  • Have your physician/practitioner complete the medical certification portion of your disability claim.

Paid Family Leave

Who can apply: If you or a family member are sick or for preventative care when civil authorities recommend quarantine

Description: Up to six weeks of benefit payments to eligible workers who have a full or partial loss of wages because they need time off work to care for a seriously ill family member.

Benefits: Approximately 60-70 percent of wages (depending on income); ranges from $50-$1,300 a week for up to 6 weeks.

Eligibility:

  • Be unable to do your regular or customary work due to the need to provide care for a seriously ill family member or to bond with a new child.
  • Be employed or actively looking for work at the time your family leave begins.
  • Have lost wages because you were caring for a seriously ill family member or bonding with a new child.
  • Have earned at least $300 from which State Disability Insurance (SDI) deductions were withheld during your base period.
  • Provide a medical certificate on your care claim for the seriously ill family member. The certificate must be completed by the care recipient’s physician/practitioner.

Paid Sick Leave

Who can apply: If you or a family member are sick or for preventative care when civil authorities recommend quarantine

Description: The leave you have accumulated or your employer has provided to you under the Paid Sick Leave law.

Benefits: Paid to you at your regular rate of pay or an average based on the past 90 days.

Eligibility:

  • Work for the same employer, on or after January 1, 2015, for at least 30 days within a year in California, and
  • Satisfy a 90-day employment period (similar to a probationary period) before taking any sick leave.

Unemployment Insurance

Who can apply: If you have lost your job or have had your hours reduced for reasons related to COVID-19

Description: Partial wage replacement benefit payments to workers who lose their job or have their hours reduced, through no fault of their own.

Benefits: Range from $40-$450 per week for up to 26 weeks.

Eligibility:

When filing for UI benefits, you must have earned enough wages during the base period to establish a claim, and be:

  • Totally or partially unemployed.
  • Unemployed through no fault of your own.
  • •Physically able to work.
  • Available for work.
  • Ready and willing to accept work immediately.
  • Actively looking for work.

Workers’ Compensation

Who can apply: If you are unable to do your usual job because you were exposed to and contracted COVID-19 during the regular course of your work, you may be eligible for workers’ compensation benefits.

Description: Benefits include temporary disability (TD) payments, which begin when your doctor says you can’t do your usual work for more than three days or you are hospitalized overnight. You may be entitled to TD for up to 104 weeks. TD stops when either you return to work, your doctor releases you for work, or your doctor says your illness has improved as much as it’s going to.

Benefits: TD generally pays two-thirds of the gross wages you lose while you are recovering from a work-related illness or injury, up to the maximum weekly amount set by law. In addition, eligible employees are entitled to medical treatment and additional payments if a doctor determines you suffered a permanent disability because of the illness.

Eligibility:

  • One event at work.
  • Repeated exposures at work

The Families First Coronavirus Response Act 

Provides for two paid leaves that employers across the United States must provide to employees in response to the coronavirus epidemic. The Act provides payroll tax credits granted to employers to offset the costs associated with these employer-provided mandates. The Act provides for two sources of paid leave: Emergency Paid Sick Leave Act and Emergency Family and Medical Leave Expansion Act.

Emergency Paid Sick Leave Act

Amount of Paid Leave:

  • Full-time employees: 80 hours of paid leave. For more info click here.
  • Part-time employees: The average number of hours worked over a two-week period. For more info click here.
  • Employers cannot require employees to use any other leave prior to using the Emergency Paid Sick Leave.
  • Employees can receive their full pay, up to $511 per day, or $5,110 total.

Eligibility:

  • The employee is subject to a Federal, State, or local quarantine or isolation order related to COVID–19.
  • The employee has been advised by a health care provider to self-quarantine due to concerns related to COVID–19.
  • The employee is experiencing symptoms of COVID–19 and seeking a medical diagnosis.
  • The employee is caring for a son or daughter of such employee if the school or place of care of the son or daughter has been closed, or the child care provider of such son or daughter is unavailable, due to COVID–19 precautions.
  • The employee is experiencing any other substantially similar condition specified by the Secretary of Health and Human Services in consultation with the Secretary of the Treasury and the Secretary of Labor.

Emergency Family and Medical Leave Expansion Act

Amount of Paid Leave:

  • First 10 days may be unpaid (but employee may use other paid leaves during this time).
  • Paid at no less than two-thirds of the employee’s regular rate of pay (as determined by the FLSA) and the number of hours the employee would normally be scheduled to work for up to 12 weeks.
  • Paid leave shall not exceed $200 per day and $10,000 in the aggregate.

Eligibility:

  • An employee who has been employed for at least 30 calendar days.
  • When the employee is unable to work (or telework) due to a need for leave to care for the son or daughter under 18 years of age of such employee if the school or place of care has been closed, or the child care provider of such son or daughter is unavailable, due to a public health emergency (with respect to a COVID-19 declared by a Federal, State, or local authority), the employee may take up to 12 weeks of leave.
